Members shared mixed experiences and advice about applying for disability in Virginia, with most agreeing that while an attorney is not required, having one greatly improves the chances of success, especially after initial denials. Several members described the typical process: being denied one or two times before hiring a lawyer for the appeals stage, with wait times ranging from as quick as three months to over four years, and emphasized the importance of being out of work for 12 months and having all medical documentation organized before applying. A recurring theme was the frustration with the slow, bureaucratic system and the feeling that it preys on sick people, balanced by encouragement to persist because the back pay and monthly benefits are worth the difficult wait.

In Virginia you can file for disability without a lawyer. typically you are denied 2 times then the 3rd time you get a lawyer and file an appeal. they will give you a court date for your hearing then you're notified after that whether you have gotten it. I am currently awaiting my decision. I do know that 1 thing my lawyer emphasized was you are supposed to be out of work for 12 months prior to applying or be able to show a tremendous decrease and work hours.

It's not difficult @A MyFibroTeam Member, that's how the lawyers earn their money by dealing with the difficult issues. The worst part is the wait but I found the lawyers to be most supportive.

Can't hurt to get one if you get rejected and you have to take it to an appeals judge and tribunal

True @A MyFibroTeam Member
The government never does care what we want or need. It's all about them and in their time.
